Privacy Policy for Android
Last updated: · Applies to Android
This Privacy Policy (hereinafter the "Policy") is established by Shosin Labs, an independent software studio (hereinafter the "Developer") with respect to the bMusic application for Android (hereinafter the "Application"). The bMusic application for iOS is covered by a separate Privacy Policy.
Article 1 (Purpose)
The purpose of this Policy is to set out the information processed by the Developer, or by third parties, in connection with the provision and use of the Application, the purposes for which such information is processed, and the means available to the User in respect of such information.
Article 2 (Definitions)
In this Policy, the following terms shall have the meanings set out below:
(a) "User" means any person who installs or uses the Application;
(b) "Library Data" has the meaning given in Article 3, paragraph 1;
(c) "Usage Data" has the meaning given in Article 4, paragraph 1;
(d) "Google" means Google LLC and, where the context so requires, its affiliates; and

Article 3 (Library Data Stored on the Device)
1. The audio files, artwork, lyrics, playlists, tags and play history of the User (hereinafter collectively the "Library Data") shall be stored on the User’s device. Lyric transcription and karaoke processing shall be performed on the User’s device. The Developer does not operate user accounts, nor does it operate any server for the storage of Library Data.
2. The Application has no synchronisation feature. The Library Data, the settings of the Application and the credentials referred to in Article 7 are excluded from the backup and device-transfer features of Android. The only data of the Application that Android may include in a backup held by Google within the User’s own Google account, or copy to a new device, is a record of when the free trial of bMusic Pro started, so that reinstalling the Application does not restart the trial. The Developer has no access to such backup.
Article 4 (Usage Data and Crash Reports)
1. The Application uses Google Firebase Analytics and Firebase Crashlytics to collect usage statistics and crash reports, comprising information on the manner in which the Application is used, the performance of the Application, the device model, the operating system version, the Application version, and the language and region settings (hereinafter collectively the "Usage Data"). Usage Data does not include the audio files, artwork or lyrics of the User, nor the text of any search entered by the User.
2. Usage Data shall be linked to a random identifier assigned to the User’s installation of the Application by Firebase (the app instance identifier), and shall not be linked to the User’s name or to any account. The Application does not read the advertising identifier or the Android ID of the device. The Developer shall use Usage Data solely for the purposes of understanding and improving the Application.
3. Usage Data is processed on behalf of the Developer by Google (see Firebase privacy information).
Article 5 (Motion, Camera and Microphone)
1. Subject to the permission of the User, the Application shall:
(a) on the Running screen, read the step detector of the device (the physical activity permission) for the purpose of matching songs to the User’s pace;
(b) on the Sing Along screen, use the microphone to record the User;
(c) on the Wi-Fi Transfer screen, use the camera to read the pairing code displayed on the User’s computer; and
(d) where the User starts a recording of the audio played by another application, capture that audio and add the recording to the Library Data.
2. Step data, camera images and recordings shall remain on the User’s device. Camera images are used solely to read the pairing code and are not stored. The step rate measured by the device is not included in Usage Data; a tempo which the User enters by hand for a running playlist is.
3. The Application does not read heart rate or any other health data, and does not use Health Connect.
4. The User may withdraw any of the foregoing permissions at any time by means of the Android Settings app.
Article 6 (Feedback)
1. Where the User submits feedback from within the Application, the Developer shall receive the message submitted, the email address of the User where the User elects to provide one, and technical information that identifies the version of the Application and the installation from which it was sent.
2. Feedback shall be used solely for the purposes of responding to the User and improving the Application.
Article 7 (Network Services)
1. In addition to the processing set out in Articles 4 and 6, the Application makes the following network connections:
(a) where the User uses Find Info & Artwork, the search terms, which are the artist and the title of the song or album concerned unless the User changes them, are sent to the iTunes Search API operated by Apple, which returns catalogue information and artwork;
(b) where the User connects the User’s own Last.fm account, the username and password entered by the User are sent to Last.fm at sign-in, the password is not stored, and thereafter the title, artist, album and duration of the songs played, and the time of playing, are sent to Last.fm;
(c) where the User pairs a computer for Wi-Fi Transfer, the pairing code, a name for the device formed from its model name, a random identifier of the device and the local network address of the device are sent to a pairing service operated by the Developer, so that the computer can find the device. Such information is used for that one pairing only and expires ten minutes after the pairing begins, after which it is deleted. Files transferred thereafter pass directly between the computer and the device over the User’s local network, and not through the Developer;
(d) where the User imports from a link, or from a WebDAV or other server, the Application connects only to the address entered by the User, using any credentials entered by the User; the password of a server which the User saves is stored on the device, encrypted with a key held by the device;
(e) where the User agrees to download it, the model required for lyric transcription is downloaded without any identifier from servers of the Developer; and
(f) the Application periodically downloads a configuration file, identical for all users, from servers of the Developer without any identifier.
2. Information sent to Apple or to Last.fm under paragraph 1 is processed by each of them in accordance with its own privacy policy.
Article 8 (bMusic Pro)
bMusic Pro is sold and processed by Google through Google Play, and is available on the User’s devices signed in to the same Google account. Whether bMusic Pro has been purchased is determined on the device from the purchase record held by Google Play. The Developer receives no payment details and no information concerning the User’s Google account.
Article 9 (Advertising)
The Application contains no advertising and does not use an advertising identifier.
Article 10 (Children)
The Application is not directed at children.
Article 11 (Deletion)

The Developer may amend this Policy from time to time. Upon any such amendment, the Developer shall revise the date indicated at the top of this page.
Article 13 (Contact)
Enquiries concerning this Policy shall be addressed to the Developer at support@shosin-labs.com.
